Can I file bankruptcy without my spouse?


If you and your spouse are jointly liable for debt, then you may both be required to file for bankruptcy. However, there are some cases where only one spouse may need to file.

If you have separate debts in your own name, then you can file for bankruptcy without involving your spouse. This is also the case if your spouse is not legally responsible for your debts.


In some instances, it may be possible to file a joint petition with your spouse, but have the bankruptcy court exempt certain assets that are only in your name. This is called a "partial exemption.
