Discharging student loans in bankruptcy: The Brunner Test

The Brunner test is designed to determine an individual’s ability to pay back their student loan debt and if they can have it discharged in bankruptcy. This test requires that three criteria must be met in order for the court to decide if an individual qualifies for a discharge of their student loan debt.


The first requirement of the Brunner Test is that an individual must prove that they are unable to repay their loans due to extenuating circumstances such as health issues, job loss or other financial hardships. The second criterion requires proof that these circumstances will persist over time so there will be no way for them to make payments on their loan even with adjustment of living expenses and income.
