Do I Need To List All of My Creditors?
When you’re considering bankruptcy, one of the first questions you may have is whether or not you need to list all of your creditors. The answer is generally yes, but there are a few exceptions.
If you’re considering Chapter 7 bankruptcy, also known as liquidation bankruptcy, you’ll need to list all of your creditors on your bankruptcy petition. This includes credit card companies, medical providers, lenders, and anyone else to whom you owe money.
Chapter 13 bankruptcy, or reorganization bankruptcy, works a little differently. In this type of bankruptcy, you’ll only need to list your secured creditors—those who have a lien on your property—on your petition. Unsecured creditors—such as credit card companies or medical providers—can be listed in your repayment plan.
