Does Bankruptcy Affect Child Support?

The topic of bankruptcy and child support is an important but often complicated one. Does filing for bankruptcy impact a parent’s obligation to pay child support? The answer depends on the type of bankruptcy, the jurisdiction in which it is filed, and other factors.

Generally speaking, when a person files for Chapter 7 or Chapter 13 bankruptcy protection, their responsibility to pay child support remains unchanged. Child support payments are considered domestic support obligations and are not dischargeable in any type of consumer bankruptcy proceeding. This means that even if all other debts are forgiven, the parent must still make court-ordered child support payments in full and on time. In fact, failure to do so could result in serious consequences such as wage garnishment or jail time.
