The length of a Chapter 13 plan depends on several factors, such as income and assets. Generally speaking, plans must last at least three years but may extend up to five years. When all payments have been made according to the plan and any other obligations of the debtor have been met, the debtor’s Chapter 13 case will end with discharge from remaining debts. After discharge has been granted by the court, creditors are no longer allowed to collect debts included in the plan; however they still can collect past due obligations that were not part of the chapter 13 payment plan agreement.
