"How Often Can You File Bankruptcy"

You can file bankruptcy as often as you like, but there are certain waiting periods that must be met in order to do so. For instance, if you filed a Chapter 7 bankruptcy and were discharged within the last eight years, you would not be able to file for another Chapter 7. However, you could file for a Chapter 13.

There are also waiting periods for those who have previously filed for a Chapter 13. If your case was dismissed within the last 180 days, you are not eligible to file again. If your case was completed or discharged within the last four years, you may be able to file again but there may be additional hoops to jump through.

It’s important to speak with an experienced bankruptcy attorney before filing again to make sure that you are eligible and that it’s the right decision for your situation.
