When it comes to filing for bankruptcy, many people have questions about how often they can do so. It is important to understand that there are limits on the number of times you can file for bankruptcy as well as rules on when you're eligible to do so.


The first thing to know is that under federal law, individuals may only file Chapter 7 or Chapter 13 bankruptcy once every eight years. In addition, if you have already filed for a particular type of bankruptcy, such as Chapter 7 and then wish to change to a different type such as Chapter 13, you will be ineligible until at least four years after your original filing date has passed. There are some exceptions where fewer than eight years have elapsed between filings, but these circumstances are rare and require an experienced attorney's assistance in order to successfully navigate the process.
