Is a Repossession Order Required When a Car Is Repossessed?


A repossession order is an official court document that authorizes a lender to take possession of a vehicle from the borrower. The question of whether a repossession order is required when a car is repossessed depends on the state in which it occurs. In some states, lenders are allowed to seize vehicles without a court order if certain conditions are met.


In states where no such law exists, lenders must obtain a court-issued repossession order before taking any action. A judge will review the evidence provided by both parties and decide whether or not to issue the order. If granted, the borrower must be notified prior to the lender taking possession of their vehicle. This allows them an opportunity to make arrangements with their lender and avoid having their car seized.
