Is It Legal To File a Second Bankruptcy Case?

Yes, it is legal to file a second bankruptcy case. However, there are certain restrictions and requirements that must be met in order to do so.

First, you must wait at least eight years from the date of your first bankruptcy discharge before you can file for another one. This is known as the "eight-year rule." There are some exceptions to this rule, however, such as if you have paid off all or most of your debts from your first bankruptcy.

Second, you must complete a credit counseling course before you can file for bankruptcy again. This requirement applies to both first-time filers and those who have filed before.

Finally, you will need to show that you have not been able to repay your debts and that filing for bankruptcy is your only option.
