In New York, wage garnishment is governed by two statutes: the State Tax Law and the Federal Consumer Protection Act. The State Tax Law allows for up to 25% of your disposable earnings to be garnished, while the Federal Consumer Protection Act limits garnishments to no more than 25% of your disposable earnings or the amount by which your disposable earnings are greater than 30 times the federal minimum hourly wage, whichever is less.
