New York State Pre- and Post-Judgment Interest Rates


As of January 1, 2019, the interest rate on money judgments entered in New York State is 9% per year. This is the same rate that has been in effect since 1995. The interest rate is set by statute and is subject to change by the legislature.

Pre-judgment interest may be awarded by the court in any action to recover damages for personal injury, breach of contract, or other tortious acts. The interest runs from the date of the accrual of the cause of action until the date of judgment. The court has discretion to award pre-judgment interest at a rate less than 9% per year if it finds that such a lower rate would be just and reasonable under the circumstances.


Post-judgment interest is payable on all money judgments entered in New York State, at the rate of 9% per year.
