What Are My Rights When a Debt Collector Is Threatening To Sue Me?

When a debt collector threatens to sue you, it can be a scary and intimidating experience. But it's important to remember that you have rights as a consumer when dealing with debt collectors, so it’s important to be aware of them before responding to any threat.

Under the Fair Debt Collection Practices Act (FDCPA), consumers are protected from certain types of debt collection abuse and harassment. For example, under the FDCPA, debt collectors cannot threaten or use violence against consumers in order to collect debts; they are also not allowed to make false statements or use deceptive tactics in order to get payment. Additionally, if a collector is threatening legal action against you, they must provide you with written notice of their intent within five days of making the threat.
