What Happens to My IRS Tax Debt if I File Bankruptcy?
When you file for bankruptcy, the court grants you an automatic stay. This means that creditors, including the IRS, cannot try to collect on your debt. The IRS may still assess your taxes, but it cannot take any collection action against you while the automatic stay is in place.
Once your bankruptcy case is over, the IRS will resume its collection efforts. If you received a discharge of your tax debt in bankruptcy, you no longer owe that debt and the IRS cannot take any collection action against you. However, if you did not receive a discharge of your tax debt in bankruptcy, the IRS can resume collection efforts against you.
