What is a Chapter 13 Bankruptcy?

Bankruptcy is a legal status of a person or other entity that cannot repay debts to creditors. In most jurisdictions, bankruptcy is imposed by a court order, often initiated by the debtor.

Chapter 13 of the United States Bankruptcy Code provides for "adjustment of debts of an individual with regular income". This chapter enables debtors, who are unable to pay their creditors in full under Chapter 7, to propose a repayment plan in which creditors are paid over a three-to-five year period. The debtor pays the trustee who then disburses payments to the creditors. If the debtor's current monthly income is less than the applicable state median, the plan will be for three years unless the court approves a longer period "for cause". (If the debtor's current monthly income is greater than the median, the plan generally must be for five years.
