A Proof of Claim in Bankruptcy is a written statement from a creditor that outlines the amount of money they are claiming from the debtor. It is required for all creditors to file a Proof of Claim when the debtor has filed for bankruptcy. The information contained in this document helps the court and trustee determine how much money, if any, should be paid to each creditor.


A Proof of Claim includes basic information like name and address of both parties involved in the bankruptcy case, amount owed by the debtor, description of debt and any reasons why payment may be due or denied. This form must be signed by an authorized person at the creditor’s company before it can be filed with the court. Creditors are required to provide evidence to support their claim such as copies of invoices or contracts with supporting documentation.
