A nonjudicial foreclosure is a type of foreclosure that does not require the involvement of a court. This type of foreclosure is often used when the borrower has given the lender permission to do so in the event that they default on their loan. The process of a nonjudicial foreclosure can vary depending on the state in which the property is located, but there are some general steps that are typically followed.


The first step in a nonjudicial foreclosure is for the lender to send a notice of default to the borrower. This notice informs the borrower that they have failed to make payments on their loan and that the lender intends to foreclose on their property. The borrower then has a certain amount of time, typically 30 days, to bring their loan current. If they are unable to do so, the next step is for the lender to file a notice of sale with the county recorder's office.
