Who Qualifies for Chapter 7 Bankruptcy?


Chapter 7 bankruptcy is often called “liquidation bankruptcy” because it requires the debtor to sell off some of their assets in order to repay creditors. In order to qualify for Chapter 7 bankruptcy, the debtor must first pass what is known as the “means test”.

The means test is a way for the courts to determine if the debtor has the ability to repay their debts. If the debtor’s income is below the median income for their state, they will automatically qualify for Chapter 7 bankruptcy. If the debtor’s income is above the median income, they will need to prove that they do not have the means to repay their debts.


Once the debtor has qualified for Chapter 7 bankruptcy, they will need to complete a mandatory credit counseling course.
