Will bankruptcy stop a levy?
When facing the prospect of a levy, many people turn to bankruptcy as a way out. But will bankruptcy actually stop a levy? The answer is yes and no.
Filing for bankruptcy can put an automatic stay on any collection attempts by creditors, including levies. This means the creditor cannot continue with the levy or take any further action against you during the stay period. So in this sense, filing for bankruptcy does stop a levy from being enforced against you.
However, it is important to note that if your debts exceed your assets and you are unable to pay them back in full through filing for Chapter 13 bankruptcy then your debt may eventually be discharged without ever paying off all of what you owe—including any levies associated with those debts.
