Will My Landlord Be Notified That I Filed for Bankruptcy?

When a tenant files for bankruptcy, the court will notify the landlord of the filing. The notification will list the tenant's name and address, as well as the case number and bankruptcy type. The landlord will also be provided with a copy of the tenants' bankruptcy schedules. The schedules list all of the tenant's creditors, including the landlord.

The notification to the landlord does not mean that the tenant is automatically protected from eviction. The automatic stay provision of bankruptcy only applies to residential tenants who have filed for Chapter 7 or Chapter 13 bankruptcy. The automatic stay stops most evictions, but there are some exceptions.

If the tenant owes rent at the time of filing, the landlord can still evict for nonpayment of rent. The landlord can also evict if the tenant is damaging the property or if the tenant poses a danger to other tenants or staff.
