Navigating New York’s Wage Garnishment Laws




If you find yourself in the unfortunate position of owing money to the state of New York, one way they may collect is through wage garnishment. This can be a confusing and stressful process, but understanding the laws can help ease some of the burden.

In New York, wage garnishment is governed by two statutes: the State Tax Law and the Federal Consumer Protection Act. The State Tax Law allows for up to 25% of your disposable earnings to be garnished, while the Federal Consumer Protection Act limits garnishments to no more than 25% of your disposable earnings or the amount by which your disposable earnings are greater than 30 times the federal minimum hourly wage, whichever is less.
