Can a Creditor Garnish or Levy My Social Security?


The answer to this question is unfortunately, yes. If you have unpaid debts, your creditors may be able to garnish or levy your social security benefits in order to satisfy the debt. This can happen even if you are receiving disability benefits or retirement benefits.


There are a few ways that creditors can garnish or levy your social security benefits. One way is through a process called wage withholding, where the creditor gets a court order requiring the Social Security Administration (SSA) to withhold a certain amount of your benefits each month and send it directly to the creditor. Another way is through levying your bank account, which means the creditor gets a court order authorizing them to take money directly out of your bank account to pay off the debt.
