Can filing bankruptcy stop a debt collection lawsuit against me?

If you're facing a debt collection lawsuit, you might be wondering if filing for bankruptcy can help. The answer is maybe. It depends on the type of debt you have and what stage the lawsuit is in.

If the debt is a non-dischargeable debt, such as child support or taxes, then filing for bankruptcy will not stop the lawsuit. The creditor can still get a judgment against you and try to collect the debt through wage garnishment or asset seizure.

If the debt is a dischargeable debt, such as credit card debt or medical bills, then filing for bankruptcy will stop the lawsuit. Once you file for bankruptcy, an "automatic stay" goes into effect that stops all creditors from trying to collect debts from you.
