Can My Spouse Be Pursued for My Debts?

When one partner accrues debt, the other partner may be held accountable in some cases. This is especially true if the couple lives in a community property state, where each spouse is equally liable for debts incurred during the marriage—regardless of whose name is on the account.


In general, creditors can go after either member of a married couple for payment on joint debts. If both spouses are liable for a debt and one spouse pays it off, the other spouse is still on the hook to the creditor. And if one spouse refuses to pay a joint debt, the other spouse may have to foot the bill.


That said, there are some instances where only one spouse may be pursued for payment on a joint debt. For example, if only one spouse co-signed for a loan or credit card, that spouse would be solely responsible for repayment even if they divorce.
