Can My Spouse Be Pursued for My Debts?

Can My Spouse Be Pursued for My Debts?

If you're married and your spouse runs up debt, can creditors come after you for payment? It depends on the type of debt and the laws in your state.

For example, if your spouse runs up credit card debt, you're usually not responsible for that debt unless you were an authorized user on the account or you live in a community property state. In a community property state, spouses are jointly responsible for debts incurred during marriage.

If your spouse takes out a loan in his or her name only, you're not usually responsible for repaying that loan unless you co-signed for the loan or live in a community property state.
