Can My Spouse Be Pursued for My Debts?


When it comes to debt, married couples are usually jointly responsible. This means that creditors can pursue either spouse for the full amount of the debt. However, there are some situations where only one spouse may be held liable.


If the debt was incurred before the marriage, then only the spouse who incurred the debt will be held responsible. This is true even if the couple later divorces. The same is true for debts that are in one spouse’s name only, such as student loans or medical bills.


There may also be circumstances where one spouse is legally responsible for the other spouse’s debt. For example, if one spouse guaranteed a loan for the other spouse, then they would be liable if the other spouse defaulted on the loan.


In most cases, both spouses are jointly responsible for each other’s debts.
